Man sentenced
to 36 years gets
new trial in Wayne
A 66-year-old man, who was sentenced to more than 36 years in prison after being convicted by a Wayne County Superior Court jury of seven sex offenses involving two young girls, has been granted a new trial.
Douglas Mitchell of Lancaster Road, Pikeville, was sentenced Sept. 25, 2003, by Judge W. Allen Cobb of Wilmington to three terms of 216 to 269 months in prison. Two terms were consolidated, leaving Mitchell with 332 to 538 months, or 36 to more than 44 years.
The N.C. Court of Appeals overturned the conviction on April 25 and ordered a new trial.
When Mitchell was granted a new trial, he was released from custody after posting a $100,000 secured bond.
Assistant District Attorney Terry Light, who prosecuted the first trial, said today that she wanted to try Mitchell again this summer.
Mitchell was sentenced to 216 to 269 months in prison after being convicted of a first-degree sex offense with a child, indecent liberties with a child, a sex offense in a parental role and abuse of a child inflicting serious injury.
Mitchell was sentenced to a second term of 216 to 269 months in prison after being convicted of a first-degree rape of a child.
He also was sentenced to a third term of 216 to 269 months in prison after being convicted of the statutory rape of a child less than 6 years old and indecent liberties with a child.
The case was investigated by Detective Sgt. Tammy S. Odom of the Wayne County Sheriff's Office.
Man sentenced
in armed holdups
A 21-year-old Goldsboro man has been sentenced to up to about eight years in prison after pleading guilty to the armed robbery of three men last year in Goldsboro.
Dwayne Lee Hardy of South Carolina Street was sentenced in Wayne County Superior Court to 70 to 102 months in prison.
Hardy also was sentenced by Judge Jack W. Jenkins of New Bern to eight to 10 months in prison after pleading guilty to fleeing to elude arrest.
Hardy was charged with the Nov. 2 robbery at a home on Brownrigg Street.
Police said the victims had gone to the home to visit friends. As they were leaving, they were approached by five people with weapons. The suspects robbed the three men of cash and other property and returned inside.
Another defendant, Jamal Clerfont, 20, of Brownrigg Street, was charged with three counts of armed robbery, but he pleaded guilty to conspiracy to commit an armed robbery.
Clerfont was sentenced Thursday to 25 to 39 months in prison. The term was suspended if Clerfont completes 36 months of supervised probation and pays $1,186 in court costs and $667 in restitution to the victims -- Christopher Cooper, Bradley T. Deaver and Brandon Barrow.
The other three people have not been tried or sentenced.
Joslyn Gabrielle Moore, 18, of Brownrigg Street was arrested the night of the holdups several blocks away. Tonenetta Kaliliah McKnabb, 20, of Creech Street was arrested two weeks later with Hardy. Ivan Lee Harvey, 20, of Birddog Lane, Dudley, was arrested Dec. 2.
Car hits truck
A car rear-ended a truck marking the lines on U.S. 70 on Wednesday and both people were injured, the Highway Patrol said.
The driver for Clark Pavement Marking Co. of Apex, Julius Devon Bolden, 29, of Raleigh, was treated and released from Wayne Memorial Hospital, a spokeswoman said. The car's driver, Jennifer Nunn Hall, 32, of Kinston, suffered minor injuries but was not treated at the hospital.
Ms. Hall was charged with failure to reduce speed. Her car sustained about $4,000 in damages. Damage to the truck was estimated at $20,000.
In other collisions:
*Damages were estimated at $5,500 in a two-car collision at 11:45 a.m. Thursday on East Ash Street near North Berkeley Boulevard, Goldsboro police said. One driver, George Joseph Wilkinson Jr., 21, of Wagon Circle, Seven Springs, was charged with a safe-movement violation. The report said Wilkinson was making a right turn from the center turn lane to enter the Hollywood Video store parking lot and the car that he was driving collided with a westbound auto. The other driver was identified as Pamela Jean Fenton, 43, of Calloway Court.
*Damages were estimated at $5,000 in a two-car crash at 4:45 p.m. Thursday at East Holly and North Lionel streets, police said. A southbound driver, Tamika Davis-Devine, 28, of Parker Place, Dudley, was charged with a stop-sign violation. Her car, the report said, collided with an eastbound auto driven by Freddie Forrest, 21, of Maple Street.
*Damages were set at $6,400 in a two-vehicle wreck at 11:05 a.m. Wednesday on U.S. 70 near Lake Wackena Road, the Highway Patrol said. One driver, Louise B. Uzzell, 89, of U.S. 70 East, was charged with failure to reduce speed. Her car rear-ended a truck driven by Theodore Roosevelt Connor III, 45, of New Bern.
*Damages were put at $8,500 in a two-truck collision at 7 a.m. Monday at N.C. 55 and N.C. 111, the Highway Patrol said. A northbound driver, Preston Edward Elmore, 50, of Pink Hill, was charged with a yield violation at a stop sign. His pickup truck, the report said, collided with an eastbound pickup driven by Jesus Miranda Gonzalez, 33, of School House Branch Road, Mount Olive.
Burglary
A 36-year-old Goldsboro man was arrested Thursday by Goldsboro police and charged with two felonies, second-degree burglary and larceny.
Samuel F. Hargrove of South Claiborne Street was accused of breaking into an apartment in the 100 block of East Elm Street and stealing a cell phone and a charger, police Officer Raymond Nash said.
Police had responded to the home to investigate a domestic dispute. After Hargrove left, the resident, Linda Adams, reported the theft. A neighbor said Hargrove had used a knife, a screw driver and a hammer to remove a linch pin in the door to get inside. A warrant was obtained for Hargrove's arrest.
Hargrove was placed in the Wayne County Jail in lieu of a $3,000 secured bond.
Drug charges
Two were arrested Thursday by authorities and charged with felony drug offenses.
*Daniel Marque McKnabb, 21, of Olivia Lane was charged by the Goldsboro-Wayne County Drug Squad with possession with intent to sell and deliver cocaine and possession with intent to sell and deliver marijuana. He was placed in the Wayne County Jail in lieu of a $30,000 secured bond. He was arrested after an anonymous call to Goldsboro-Wayne County Crime Stoppers about drug use at Wayne Avenue and Sycamore Street.
*Quintin Alston, 27, of Potts Road, Dudley, was charged by Goldsboro police with possession of marijuana in a prison, where he was visiting. He was placed in the Wayne County Jail in lieu of a $5,000 secured bond.
Shots hit home
Gunshots were fired before dawn today into a wall of an apartment in the 400 block of North Carolina Street, Goldsboro police reported. No one was injured.
Police, however, did not find any shell casings or bullets. The resident, Betty J. Phillips, estimated damage at $1,000.
Missing
A 16-year-old boy was reported missing Thursday by relatives to the Wayne County Sheriff's Office. Joshua Earl Gurley of 104 Muriel Hooks Drive was described as white, 5-foot-5 and 140 pounds with blond hair and hazel eyes.
When Gurley was seen last at 5:30 p.m. Monday, he was wearing a green T-shirt and blue jeans. Anyone with information on his location was asked to call the Sheriff's Office at 731-1481.
