Eric Glenn Lane, the convicted killer of 5-year-old Precious Ebony Whitfield, will have his appeal heard by the Supreme Court of North Carolina.

Lane, who is on "death row" for the slaying of his neighbor, in the Nahunta Creek area of Wayne County, had been assigned the death penalty after his trial for the May 2002 death.

Because this is Lane's first trip through the appeals process, which can take many years, the state Supreme Court justices will consider primarily if any errors were made by judges or attorneys in Lane's first-degree murder trial.
