Suspect will be indicted for rape

The Wayne County Grand Jury is considering indicting a man today for charges that wrongfully imprisoned another man for 18 years.

Dwayne Dail served another man's time for a 1987 rape, but was finally freed after police and his lawyers discovered DNA evidence that cleared his name.

Today, Superior Court Judge Jerry Braswell presides over the Wayne County Grand Jury, who will consider if there is enough evidence to indict a man in prison for the rape of a 12-year-old girl.

The victim in the crime singled out Dail on the street, pointing him out to her mother.

Prosecutors used the victim's statement and hair "similar" to Dail's which had been collected from a rug at the girl's home.

Prosecutors were not available for comment this morning.

Dail and his attorney, Chris Mumma are speaking to forensics experts at a Florida university today, and were also unavailable for comment.

The decision of the grand jury on all indictments considered is expected sometime Monday afternoon, authorities said.
