A Fremont teenager died today after being shot in the chest in a car on Albert Drive. Another teen was arrested by the Wayne County Sheriff's Office and charged with murder.

The victim, John Setliff, 17, of East Wayne Street, was rushed by ambulance to Wayne Memorial Hospital for treatment. He died at about 10 a.m. while undergoing surgery, Sheriff's Capt. George Raecher said.

Timothy W. Alston, 19, of White Oak Road was charged originally with assault with a deadly weapon inflicting serious injury. When Setliff died, the charge was upgraded to murder.

Alston was placed in the Wayne County Jail without bond. His first court appearance was scheduled for Tuesday to determine his legal representation.

The lead investigator, Detective Sgt. Rick Farfour, said alcohol and drugs were involved.

Sheriff's Sgt. Sherwood Daly and Pikeville Police Officer Chris Jackson responded at about 2:35 a.m. to a shots-fired call and found Setliff in a vehicle. Four teens were in the vehicle when the handgun discharged, detectives said.

Witnesses said Alston was twirling the gun on his finger when it went off, striking Setliff.

When Daly and Jackson arrived, Alston scuffled with them before being arrested. A weapon was found in Alston's pants. Daly said Alston appeared to have been reaching for the weapon but he was handcuffed without anyone being injured.

A-shift patrol deputies and two sheriff's detectives, Sgt. Ray Brogden and Robert Golimowski, assisted in the investigation. Maj. Ray Smith and Capt. George Raecher also responded.
