A Pikeville man under investigation by the Havelock Police Department since August for allegedly distributing child pornography over an Internet network could also be charged federally, the Wayne County Sheriff's Office said.
Andrew Floyd Fabian, 58, of 209 Duck Ridge Drive, Pikeville, is charged with three counts of sexual exploitation of a child.
Fabian was placed in the Wayne County Jail under a $5,000 secured bond. As of 9 a.m. today, Fabian was no longer in custody, according to jail records.
Maj. Tom Effler said Fabian was caught sending child pornography over what is called a peer-to-peer network.
"There are lots of these types of networks, the Sheriff's Office has one for information sharing," he said.
The type of network Fabian was allegedly using would likely have other offenders on it, and they would trade information back and forth containing the pornography, he said.
Fabian's transmissions were intercepted by police, however.
According to a press release, investigators with the Havelock Police Department's N.C. Internet Crimes Against Children Task Force contacted the Wayne County Sheriff's Office on Aug. 21 to inform local authorities of their investigation.
Sheriff's Office Internet crimes task force deputies joined the investigation and contacted the Department of Homeland Security and FBI.
Both federal agencies also joined the investigation.
At 6 a.m. Tuesday, deputies and federal agents executed a search warrant at Fabian's home and found a computer containing child pornography, the press release said.
Sheriff's office investigators Lt. Tom Flores and Det. Sgt. Mike Kabler charged Fabian and took him into custody.
Additional state and federal charges are pending.
